Anti-SLAPP Motions

A CCP §425.16 anti-SLAPP motion is often defendant’s opening salvo in a civil lawsuit. And it is a potent weapon: It prevents entry of default and “freezes” discovery; it also provides attorney fees if defendant wins and a right of immediate appeal if defendant loses!

Reflecting the anti-SLAPP motion’s widespread use, there are scores of new appellate cases each year dealing with it. In addition, the Legislature has been active with amendments and exceptions to the anti-SLAPP statute, and has created an “anti-SLAPPback” motion (CCP §425.18) to attack malicious prosecution actions based on earlier lawsuits dismissed pursuant to §425.16.

This three-hour program will bring you up to date. Our panelists include lawyers who specialize in anti-SLAPP motions and an appellate justice who has written extensively in this field. They will explain the intricate statutory scheme and the impact of new cases.
