§17200 Practice After Prop. 64
Proposition 64 effected the most sweeping change in Section 17200 practice in over 40 years. It eliminated the "unaffected plaintiff" standing rule that had prevailed for decades. And it eliminated "representative" actions – the so-called "nonclass class" action. The California Supreme Court ruled that Proposition 64 applies to cases pending as of its November 3, 2004 effective date, but that still leaves many important questions unanswered:
- Does Proposition 64 require proof of "reliance"?
